This section applies to the following products and services:
- HSBC Premier Investment Management Service and Investors Settlement Plan
- HSBC Trust Discretionary Investment Service
Under the Terms and Conditions, your assets are subject to third party rights or interests which impact your ownership status of these assets. These rights or interests include:
- Rights of lien, security interest or right of set off against unpaid costs and charges and other amounts payable by you to us; and
- Rights of lien, security interest or right of set off where your assets are deposited with a third party (including a sub-custodian or central securities depository) who (a) will have these rights in respect of any fees or charges arising from the provision of services by that third party in respect of your assets; or (b) depending on the market in which your assets are held the third party may have these rights to the extent required by applicable law in that country in relation to other debts owed.
Therefore, as a result of the existence of these rights, your assets may be used to cover debts which arise in circumstances where either you fail to pay an amount due to us or where a third party within the custody chain goes insolvent or fails to meet their payment obligation to another member of the custody chain.
